Terms of Service

Welcome to AAFC (Aesthetic Archive for Clinics). These Terms of Service ("Terms") govern your access to and use of the AAFC mobile applications, web panel, and related services (collectively, the "Service") operated by EDECA Yazılım Ticaret ve Sanayi Limited Şirketi ("EDECA," "we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility and Use

AAFC is a documentation and archive tool intended for licensed medical professionals, including aesthetic doctors, plastic surgeons, dermatologists, ENT specialists, and clinic personnel. By using the Service, you confirm that:

• You are at least 18 years old and legally competent to enter into this agreement.
• You hold the appropriate professional license or authorization to handle medical photographic records in your jurisdiction.
• You will use the Service in compliance with all applicable laws, including medical data protection regulations (such as KVKK, GDPR, or HIPAA).

2. Account and Security

To use most features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, including activity by team members you invite via Multi-User Clinic Access.
• Notifying us immediately at support@aafclinic.com if you suspect unauthorized access.

3. Subscription and Billing

AAFC offers a paid subscription plan, AAFC Premium, billed on a monthly auto-renewing basis at $49.99 USD (or local equivalent) per month after a 14-day free trial.

• Subscriptions are processed by Apple App Store or Google Play. All payment, billing, refund, and cancellation policies of the respective store apply.
• Your subscription will renew automatically at the end of each billing period unless canceled at least 24 hours before renewal.
• Cancellation must be done through your App Store or Google Play account settings. We do not process cancellations directly.
• Refunds, where applicable, are handled by the respective store under their refund policy.

4. Patient Data and Your Responsibilities

AAFC is a tool for storing and organizing data that you, the licensed user, choose to upload. You retain ownership of all data you input.

• You are solely responsible for obtaining lawful patient consent before storing identifiable medical photographs or personal data.
• You are responsible for compliance with all medical-data laws applicable in your country or region.
• EDECA is not the data controller for the patient data you upload. You act as the data controller; EDECA acts as a data processor on your behalf, in accordance with our Privacy Policy.

5. Intellectual Property

The Service, including its software, design, logos, and trademarks, is the exclusive property of EDECA. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our prior written consent.

Content you upload (patient data, photos, notes) remains yours. You grant EDECA a limited license solely to host, process, and display this content for the purpose of operating the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of medical regulations.
• Upload content that is illegal, harmful, or infringes on third-party rights.
• Attempt to gain unauthorized access to other accounts or systems.
• Use the Service to share or transmit malicious software.
• Reverse-engineer, decompile, or extract source code of the Service.

7. No Medical Advice

AAFC is a documentation and archive tool. It does not provide medical advice, diagnosis, treatment recommendations, or clinical decision support. Any clinical decisions remain the sole responsibility of the licensed practitioner using the Service.

8. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, upgrades, or operational reasons without prior notice.

9. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a manner that creates legal or operational risk. You may stop using the Service at any time.

Upon termination, you may request data export and deletion via our Account Deletion page. Subscription cancellations must be processed through the respective app store.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. EDECA disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, EDECA, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of or related to your use of the Service.

EDECA's total aggregate liability shall not exceed the amount you paid to EDECA in the twelve (12) months preceding the event giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Manisa, Türkiye, except where mandatory consumer protection laws of your country provide otherwise.
